Agreement to Terms

Welcome to the Sports Car Club of America™ (“SCCA,” “we,” “us,” or “our”) website (the “Site”). These Terms of Use (“Agreement”) govern your access to and use of the Site. By accessing or using the Site, or by clicking to accept these terms where they are presented to you, you acknowledge that you have read and understood this Agreement and agree to be bound by it. If you do not agree to these terms, please do not use the Site.

SCCA may update this Agreement at any time. Continued use of the Site after changes are posted constitutes acceptance of the revised terms. If you are dissatisfied with the Site or these terms, your sole remedy is to discontinue using the Site.

Use of the Site

You may link to the Site’s homepage or a public page, provided the link does not portray SCCA, its affiliates, or its members in a false, misleading, derogatory, or offensive manner, and does not use an SCCA logo or trademark as part of the link itself without permission. Unauthorized use terminates the license granted under this Agreement.

You may not use the Site to post, transmit, or communicate:

  • Harassment or promotion of harassment against any group or individual
  • Solicitation of information about individuals under 18
  • Spam, chain letters, or unauthorized advertising

SCCA reserves the right to remove content, deny access, investigate suspected violations, and report unlawful activity to appropriate authorities. SCCA is under no obligation to monitor content submitted through the Site.

Site Content and Ownership

All content on the Site not submitted by users — including text, images, designs, and data — is the property of SCCA and is protected by copyright, trademark, and other applicable laws. You may not use this content except as expressly permitted by this Agreement or with SCCA’s written consent, and you must retain all copyright and proprietary notices on any authorized copies.

The Site may include standard forms (such as contact or inquiry forms) through which you can submit information to SCCA. You are responsible for the accuracy and legality of anything you submit, and agree not to submit unlawful, infringing, or unauthorized material. Information you submit through the Site is handled in accordance with SCCA’s Privacy Policy. If SCCA introduces features that allow broader user submissions (such as photo uploads), this Agreement will be updated to describe the terms that apply to those submissions.

Disclaimer of Warranty

THE SITE AND ITS CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, AND YOUR USE OF THE SITE IS AT YOUR OWN RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, SCCA DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. SCCA MAKES NO WARRANTY OR REPRESENTATION REGARDING THE ACCURACY, COMPLETENESS, RELIABILITY, CURRENCY, QUALITY, SECURITY, OR AVAILABILITY OF THE SITE OR ITS CONTENT, OR REGARDING THE RESULTS THAT MAY BE OBTAINED FROM USE OF THE SITE. WITHOUT LIMITING THE FOREGOING, SCCA DOES NOT WARRANT THAT THE SITE OR ITS CONTENT WILL BE ACCURATE, ERROR-FREE, UNINTERRUPTED, OR SECURE, THAT DEFECTS WILL BE CORRECTED, THAT THE SITE OR ITS SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE SITE WILL OTHERWISE MEET YOUR REQUIREMENTS, NEEDS, OR EXPECTATIONS. SCCA IS NOT RESPONSIBLE FOR, AND DISCLAIMS ALL LIABILITY ARISING FROM, ANY FAILURE OR INTERRUPTION OF THE INTERNET, NETWORKS, OR TELECOMMUNICATIONS SERVICES OUTSIDE SCCA’S REASONABLE CONTROL, OR FOR ANY THIRD-PARTY CONTENT, MATERIALS, PRODUCTS, SERVICES, OR WEBSITES LINKED TO OR ACCESSIBLE THROUGH THE SITE. YOU ARE RESPONSIBLE FOR IMPLEMENTING YOUR OWN ANTI-VIRUS PROTECTION AND DATA-BACKUP MEASURES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU , AND THIS DISCLAIMER DOES NOT AFFECT ANY WARRANTY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL SCCA OR ITS REGIONS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, OR AGENTS BE LIABLE UNDER ANY LEGAL OR EQUITABLE THEORY (INCLUDING CONTRACT, TORT, NEGLIGENCE, OR OTHERWISE), FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE, EVEN IF SCCA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. [TO THE FULLEST EXTENT PERMITTED BY LAW, SCCA’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE OR THIS AGREEMENT WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).] THESE LIMITATIONS REFLECT AN AGREED ALLOCATION OF RISK AND FORM AN ESSENTIAL BASIS OF THIS AGREEMENT, AND THEY APPLY EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE. THE FOREGOING LIMITATIONS DO NOT APPLY TO LIABILITY ARISING FROM SCCA’S GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, OR FOR DEATH OR BODILY INJURY, OR TO ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

Indemnification

You agree to indemnify, defend, and hold harmless SCCA, and its Regions, affiliates, licensors, and service providers, and its and their respective officers, directors, employees, volunteers, and agents,  from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Site; (b) your violation of this Agreement; (c) any content or information you submit through the Site; (d) your use of Site content, services, or information other than as expressly authorized in this Agreement; or (e) or your violation of any law or the rights of a third party.

Privacy

SCCA’s Privacy Policy describes how information submitted through the Site is collected and used, and is available at https://scca.com/utility/privacy-policy/. The Member Account Portal (MAP) and third-party event registration platforms have their own separate privacy policies governing information submitted through those systems.

Purchases and Third-Partry Services

SCCA.com does not process purchases, membership transactions, or event registrations directly. Membership transactions are processed through the Member Account Portal (MAP) at my.scca.com. Event registrations are processed through third-party platforms. Your use of those platforms is governed by their own applicable terms of use, separate from this Agreement.

Age Requirement

You must be 18 years of age or older to submit information through the Site. Individuals under 18 may use the Site only with the involvement of a parent or legal guardian. Participation by minors in SCCA-sanctioned junior programs is subject to the terms of the applicable registration platform and MAP, not this Agreement.

Term and Termination

SCCA may suspend, terminate, or restrict your access to the Site at any time, in its sole discretion, without notice, including for violations of this Agreement.

Links to Other Websites

The Site may include links to websites operated by SCCA Regions, partners, or other third parties (“Linked Sites”). SCCA does not control, endorse, or assume responsibility for the content, accuracy, or privacy practices of any Linked Site. Accessing a Linked Site is at your own risk, and you should review that site’s own terms and privacy policy.

Regional Websites

Some SCCA Regions operate websites hosted within the SCCA.com platform using Region-specific subdomains. This Agreement governs your use of those Region websites to the same extent as SCCA.com. Content published on Region websites is managed by the respective SCCA Region and may not reflect the views or policies of the national organization. SCCA is not responsible for content published by individual Regions.

Dispute Resolution; Binding Arbitration; Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES YOU AND SCCA TO RESOLVE MOST DISPUTES THROUGH BINDING INDIVIDUAL ARBITRATION RATHER THAN IN COURT, AND IT WAIVES YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION. IT AFFECTS YOUR LEGAL RIGHTS.

Informal resolution first. Before initiating arbitration, you and SCCA agree to try to resolve any dispute informally. You agree to send SCCA a written notice describing the dispute and the relief you seek to the address in the “Contact Information” section below, and SCCA will send you such a notice at the contact information it has for you. If the dispute is not resolved within sixty (60) days after the notice is received, either party may initiate arbitration.

Agreement to arbitrate. Except for the disputes described in “Exceptions” below, you and SCCA agree that any dispute, claim, or controversy arising out of or relating to this Agreement or your access to or use of the Site (a “Dispute”) will be resolved by binding arbitration on an individual basis, rather than in court. This Agreement evidences a transaction involving interstate commerce, and the Federal Arbitration Act (9 U.S.C. §§ 1 et seq.) governs the interpretation and enforcement of this section. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules and, where applicable, its Mass Arbitration Supplementary Rules, as modified by this Agreement. The arbitrator’s award may be entered in any court of competent jurisdiction.

Class action waiver. You and SCCA agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate or join the claims of more than one person, and may not preside over any form of a class, collective, or representative proceeding, except that the AAA (or other administrator) may administer and coordinate multiple individual arbitrations, including through batching or consolidation of filing and administrative processes as permitted by its rules.

Exceptions. This section does not require arbitration of: (a) an individual claim brought in a small claims court of competent jurisdiction, so long as it remains on an individual basis; or (b) a claim for injunctive or other equitable relief to prevent the actual or threatened infringement, misappropriation, or violation of a party’s intellectual property or proprietary rights.

Your right to opt out. You may opt out of this Dispute Resolution section within thirty (30) days after you first accept this Agreement by sending written notice of your decision to opt out to the address in the “Contact Information” section below, stating your name and an intent to opt out of arbitration. If you opt out, the “Governing Law and Jurisdiction” section below governs your Disputes. Opting out of arbitration has no effect on any other part of this Agreement.

Severability. If the class action waiver above is found to be unenforceable as to a particular claim or request for relief, then that claim or request for relief (and only that claim or request for relief) will be severed from the arbitration and may be brought in the courts identified in the “Governing Law and Jurisdiction” section below, while all other Disputes will proceed in arbitration. If any other portion of this section is found to be unenforceable, the remainder of this section will remain in effect.

Governing Law and Jurisdiction

This Agreement is governed by the laws of the State of Kansas, without regard to conflict-of-law principles. Except for Disputes subject to arbitration under the “Dispute Resolution; Binding Arbitration; Class Action Waiver” section above, you agree to submit to the personal and exclusive jurisdiction of any state court located in Shawnee County, Kansas, or the United States District Court for the District of Kansas, for any dispute arising out of your use of the Site. This jurisdiction provision also governs any Dispute that proceeds in court because it falls within the “Exceptions” or “Severability” provisions above, or because you have opted out of arbitration. SCCA makes no representation that the Site is appropriate for use outside the United States; if you access the Site from outside the United States, you are responsible for compliance with applicable local laws.

Entire Agreement

This Agreement constitutes the entire agreement between you and SCCA regarding use of the Site and supersedes any prior agreements or communications on the subject. If any provision of this Agreement is found unenforceable, the remaining provisions will remain in full force and effect.

Changes to This Agreement

SCCA may revise this Agreement at any time. Changes take effect once posted to the Site. Continued use of the Site after a revision constitutes acceptance of the updated terms.

Electronic Communications

By using the Site, you consent to receive communications from SCCA electronically. Any consent, agreement, or affirmation you provide through the Site (such as clicking an “I agree” button) is legally binding and has the same effect as a handwritten signature.
